Property Diversion
The FCS Property Diversion program is the result of a collaborative effort between experienced officers and FCS instructors, along with discussions with judges, probation officers and offenders. This program is based on the belief that not all individuals belong in a court room, and it allows offenders an opportunity to redeem themselves through education and meaningful accountability for their actions.

Why Property Crimes Diversion?
After numerous conversations with our jurisdictions, it seemed that property crimes diversion was a logical choice and a significant process to support law enforcement efforts. Resources are often limited in efforts to deal with low level offenders; therefore, property crimes diversion helps provide:

  • A more direct and proactive approach toward consequences and offender training
  • A more expedient approach for offenders
  • Cost and time savings
  • Satisfaction for victims and meaningful accountability for offenders

Program Benefits

  • No cost to city, county or victim
  • Reduced staff and attorney time
  • Classes separated between adults and juveniles, and can be set up for misdemeanors, gross misdemeanors and  felonies
  • Adult offender’s record is active and monitored for eight years, and this may be used in pre-trial sentence investigation if re-offenses occur
  • Offenders are tracked cross-jurisdictional in participating agencies to provide a better offender history
  • No offender information is used for any purpose other than tracking re-occurrence, aggregation of property crimes charges and determining case outcomes
  • FCS supports clearing up any backlog of cases pending

Offender Benefits, Expectations

  • Avoids public record
  • Must write letter and mail to victim
  • Obligated to pay restitution
  • Required to attend class for training within 45 days of program acceptance
  • Voluntarily participates in paying any further financial obligations (i.e., estimated court costs, attorney fees, etc.)

  • Trained instructors provided
  • Offender training dates and sites established as needed
  • Accountability tracked and payment plans set up for restitution
  • Attendance roster emailed to jurisdiction on classes and attendees
  • Jurisdiction notified upon completion of class
